Personal Representative / Estate Services

A personal representative (“PR”) plays a crucial role in managing the assets and liabilities of an individual’s estate after their death. A PR is court appointed and court supervised by a probate court, so there are formalities and important rules to follow. The PR’s responsibilities include collecting and managing the decedent’s assets, paying debts and taxes, and distributing the remaining assets according to Oregon law. The PR also has responsibilities to the probate court and they must be aware of and follow the relevant legal requirements, which involves filing necessary court documents and informing the estate’s beneficiaries. The PR is also responsible for managing real estate, bank accounts, liquidating and consolidating property, and various other financial responsibilities to move towards closing the estate. The term "personal representative" is often used interchangeably with "executor" or "administrator”.

Trust Services

A trustee is the manager who is responsible for the trust estate. A trustee manages the assets and liabilities of the trust estate for the benefit of the trust beneficiaries. Trustees have strict fiduciary responsibilities, or affirmative duties, to the trust beneficiaries, requiring them to manage the assets reasonably and for the best interests of the beneficiaries. The numerous responsibilities of a trustee often vary based on the specific terms of the trust agreement they are managing, as well as relevant real-world circumstances that impact the trust assets, liabilities and beneficiaries.

Conservatorships

A conservatorship is a court action with court oversight where the court appoints a person or entity as the conservator, in order to manage the financial affairs of an individual who is unable to do so themselves. A conservator manages that conservatorship estate for a protected person, often due to incapacity or other reasons, such as aging, illness, disability, or cognitive decline. The legal process to initiate a conservatorship involves a petition filed in court that demonstrates the need for a conservatorship estate, providing evidence of the individual's financial incapacity, and information on the nominated conservator’s suitability to act as conservator.
